• Modify, suspend, or discontinue any features at any time

We will provide reasonable notice for planned maintenance whenever possible.

Our pricing plans are available on our website. By subscribing to our services, you agree to:

• Automated daily backups with 30-day retention

Your Responsibilities: You are responsible for maintaining backups of your critical data and for securing your applications.

By You: You may terminate your account at any time through your account settings. Upon termination, you will lose access to your account and all associated data.

By Us: We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or fail to pay applicable fees. We will provide notice when possible, but we reserve the right to terminate immediately for severe violations.

Effect of Termination: Upon termination, we will delete your data within 90 days unless we are required to retain it for legal purposes. You remain responsible for any fees incurred before termination.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that our services will be uninterrupted, secure, or error-free

We do not warrant that our services will meet your specific requirements or expectations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEOFYS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from interruption or cessation of services

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Neofys and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any rights of another party
• Your content or applications hosted on our platform

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

These terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

Entire Agreement: These terms constitute the entire agreement between you and Neofys regarding our services.

Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in effect.

Waiver: Our failure to enforce any right or provision of these terms will not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these terms without our written consent. We may assign these terms without restriction.
